RE: The tariff classification of a bulletproof vest from Brazil.
Dear Ms. Ckless:
In your letter, you requested a tariff classification ruling for a bulletproof vest. The sample will be returned to you as requested.
The submitted sample, Glagio Body Armor, is a bulletproof vest made of man-made fiber fabric. The sleeveless garment has a hook and loop closure at the shoulders and waist, allowing it to adjust to the body. This vest is designed for military, police, and general security use.
The applicable subheading for the bulletproof vest is 6211.43.0091, Harmonized Tariff Schedule of the United States (HTS), which covers "Track suits, ski-suits and swimwear; other garments: Other garments, women’s or girls’: Of man-made fibers, Other." The duty rate is 16% ad valorem.
This ruling is issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

RE: The tariff classification of a bulletproof carrier and ballistic panel from Vietnam.
Dear Mr. Vilay:
In your letter dated February 16, 2012, you requested a tariff classification ruling for a bulletproof carrier and ballistic panel. The samples will be returned to you as requested.
The submitted sample, Style 32V500-04-CTS, is a bulletproof carrier made of nylon fabric. The unisex garment resembles a vest and provides no ballistic protection without the steel plates. It is a carrier for the steel insert that provides ballistic protection. The garment consists of two pieces, front and back, which are attached to each other with straps and hook and loop closures.
The applicable subheading for the bulletproof carrier is 6211.43.0091, Harmonized Tariff Schedule of the United States (HTSUS), which covers "Track suits, ski-suits and swimwear; other garments: Other garments, women’s or girls’: Of man-made fibers, Other." The rate of duty is 16% ad valorem.

You also requested the classification of ballistic armor panels and a bulletproof carrier with armor panels under Schedule B.
The submitted sample, Style C32SP13-MD-ST34A, is a ballistic armor panel constructed of woven nylon fabric coated with polyurethane, surrounding inner layers of woven Kevlar fabric.
For export purposes, the ballistic armor panels are classifiable under Schedule B number 6217.90.9085; the bulletproof carrier with armor panels are classifiable under Schedule B number 6211.43.0091.
This ruling is issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
